COVID-19 Victorian residential eviction moratorium extended
The Victorian Government has extended the eviction moratorium until the end of the year.
Evictions continue to be banned for both residential and commercial tenancies, except under certain circumstances, until 31 December 2020. Rental increases continue to be banned for the same period.
Residential tenants and landlords who struggle to reach agreement over rent reductions have access to the dispute resolution service run by Consumer Affairs Victoria for residential tenancies. The Victorian Small Business Commission offers a similar service for commercial tenancies.
Residential and commercial tenants and landlords can also take advantage of more support, including further land tax reductions and more grant funding.
The moratorium on evictions will apply from 29 March until 31 December 2020.
Landlords cannot increase the rent between 29 March and 31 December.
They can increase the rent after this period, but only within the terms of the lease agreement and the Residential Tenancies Act.
It means that tenants can’t be evicted if they are served a notice to vacate between 29 March and 31 December 2020 because you can’t pay your rent due to the impacts of coronavirus (COVID-19) on your financial situation.
This will apply for a tenant or sub-tenant:
- in a residential property
- living in a rooming house
- in social housing
- under a site agreement at a caravan park
- in specialist disability accommodation.
